This document, titled Terms of Use and Services (“T&S”), governs access to and use of the Platform. Below, we clarify some points we consider important. In this instrument, the terms below are understood according to the following definitions:
AKQUINET HKS BRASIL: AKQUINET HKS SOLUCOES EM TECNOLOGIA DA INFORMACAO LTDA, a limited liability company registered under CNPJ No. 16.528.380/0001-71.
PLATFORM: A system consisting of a Web Platform available at the link https://app.mub.one/ and its subdomains, offered by AKQUINET HKS BRASIL, owned, operated, and managed by AKQUINET HKS BRASIL, where all USERS can view and use the available functionalities.
PERSONAL DATA PROCESSING: Any operation performed by AKQUINET HKS BRASIL with USERS’ personal data, such as collection, production, receipt, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination, or extraction.
USER(S): An individual or legal entity registered on the PLATFORM, who accesses and/or uses the services offered through the PLATFORM.
This instrument regulates the conditions of use of the PLATFORM’s services, constituting a contract between USERS and AKQUINET HKS BRASIL. By using our services, you expressly indicate that you agree with all the terms and conditions contained herein and with the applicable legal provisions.
The USER understands that the subscription to the services offered will be made through free or prepaid monthly or annual plans, budgeted and provided by AKQUINET HKS BRASIL.
To use the PLATFORM, the USER acknowledges the need to install all necessary software and possess all equipment and licenses required for its proper operation.
The USER acknowledges that records of their acceptance, including the date and time of such acceptance, as well as records of access and use of the PLATFORM, will be stored by AKQUINET HKS BRASIL.
The USER understands that the implementation process of the AKQUINET HKS BRASIL software, following the subscription to the service, will incur a mandatory implementation fee, as budgeted by AKQUINET HKS BRASIL.
If requested and subject to AKQUINET HKS BRASIL’s availability, onboarding services may be offered remotely to the USER by one of AKQUINET HKS BRASIL’s Consultants.
If you DO NOT AGREE with the terms set forth in this T&S, DO NOT CLICK “SIGN UP” or access, view, download, or use any page, content, information, or service from AKQUINET HKS BRASIL in any way. Using our services expressly indicates that you agree with all terms and conditions contained in this T&S and with the applicable legal provisions.
AKQUINET HKS BRASIL is a private company that offers a PLATFORM consisting of software designed to optimize and simplify registration and business processes, enabling USERS to access structured information in their respective operations.
AKQUINET HKS BRASIL’s responsibilities are limited solely to ensure the proper functioning of the PLATFORM and guarantee access to its USERS upon prior payment through the portal https://app.mub.one/ and its subdomains.
AKQUINET HKS BRASIL bears no responsibility for:
(i) any breach by a USER of agreements made during negotiations with other USERS or third parties;
(ii) damage resulting from the inability to use the PLATFORM;
(iii) incorrect completion of data by the USER on the PLATFORM;
(iv) data made available by USERS through the PLATFORM;
(v) Any other act or event resulting from the conduct of USERS.
AKQUINET HKS BRASIL grants a temporary, non-exclusive, non-transferable, and revocable license, at its discretion, for USERS to access the PLATFORM, subject to the following conditions:
(i) All licensed services used are subject to the provisions of these T&S.
(ii) Licensed services must be used solely for the USER’s operations and may not be transferred to third parties.
(iii) All commercial use licenses sold through the Portal are temporary, valid for the period paid by the USER. Non-payment of any subsequent period will result in immediate cancellation of access to the licensed service, which will only be reactivated upon proof of payment of the outstanding amount.
(iv) Licensed services will be continuously updated through the PLATFORM automatically whenever a new version is released. Changes to the licensed services may occur at any time due to version updates, and the USER consents to such changes upon subscribing to any service license.
(v) USERS subscribing to the PLATFORM’s free plan acknowledge the predefined usage limitations set by AKQUINET HKS BRASIL and that AKQUINET HKS BRASIL may revoke the granted access license at any time and for any reason it deems appropriate.
(vi) The services available on the PLATFORM are licensed to the USER, who must ensure that the service, as offered, meets their needs. The USER may not hold AKQUINET HKS BRASIL liable if they later determine that the licensed service does not meet their requirements.
(vii) Any damage, for any reason, resulting from misuse, accidents, malpractice, recklessness, or negligence by the USER in using the PLATFORM is the sole responsibility of the USER, with no joint or subsidiary liability attributable to AKQUINET HKS BRASIL.
(viii) AKQUINET HKS BRASIL will not be liable for damages to the USER resulting from unauthorized changes to the PLATFORM, system intrusions, viruses, or other harmful elements.
(ix) AKQUINET HKS BRASIL will not be liable for decisions made by the USER based on the use of the PLATFORM’s functionalities.
The USER understands that internet access is required to use the PLATFORM, for which AKQUINET HKS BRASIL bears no responsibility.
The PLATFORM can be used on computational devices with standard market internet browsers (e.g., recent versions of Google Chrome and Firefox). Mobile devices may access it through their browsers, though some system screens may have restrictions.
The USER acknowledges that minor programming defects or temporary unavailability of the PLATFORM are common to all software, thus exempting AKQUINET HKS BRASIL from liability for damages arising from typical defects beyond the normal use of the worldwide computer network. AKQUINET HKS BRASIL’s responsibility is limited to correcting such minor programming defects.
The services offered by AKQUINET HKS BRASIL are available to fully capable individuals and legal entities duly registered with a CNPJ.
Complete and accurate completion of all data requested by the PLATFORM during registration is required for USERS to be enabled to use the PLATFORM.
The registration of USERS on the PLATFORM will be carried out through the provision and processing of the following data to AKQUINET HKS BRAZIL: a) CNPJ number of their commercial establishment or CPF; b) Full name or corporate name; c) Name of the responsible administrator; d) Email address; e) Full address; f) Business segments of the company.
The collection of USER data aims to identify them and enable their use of the services provided on the PLATFORM, ensuring the quality of the contracted services.
The USER recognizes that without the aforementioned data, AKQUINET HKS BRASIL will be unable to guarantee the PLATFORM’s functionality and, consequently, the provision of contracted services.
It is the sole responsibility of USERS to provide, update, and ensure the accuracy of registration data. AKQUINET HKS BRASIL bears no civil or criminal liability for inaccurate, incorrect, or incomplete data provided by USERS.
AKQUINET HKS BRASIL reserves the right to use all valid and possible means to identify its USERS and to request additional data and documents it deems relevant to verify the information provided. In such cases, the USER’s use of the PLATFORM is contingent upon submitting the requested documents.
The USER will access their PLATFORM account using login and password, agreeing not to disclose this information to third parties and assuming full responsibility for its use.
The USER may use the PLATFORM on as many computers as desired, respecting the number of contracted licenses.
The USER may access the data collected and processed by AKQUINET HKS BRASIL free of charge through the link https://app.mub.one/ and its subdomains and may request its editing or deletion at any time.
The USER agrees to immediately notify AKQUINET HKS BRASIL, through the help channel provided on the PLATFORM, regarding any unauthorized use of their account.
The USER will be solely responsible for operations carried out in their account, as access is only possible with the use of a password known exclusively to them.
The USER agrees to immediately notify AKQUINET HKS BRASIL, through the contact channels provided on the PLATFORM, regarding any knowledge of irregularities by other USERS that may cause harm to the PLATFORM’s USERS, the PLATFORM itself, AKQUINET HKS BRASIL, or third parties.
Under no circumstances will the assignment, sale, rental, or any other form of transfer of the USER’s account be permitted.
At its sole discretion, AKQUINET HKS BRASIL may, without prior notice or compensation, delete, disable, suspend, or block USER registrations that violate the terms of this T&S or applicable law, for an indefinite period.
AKQUINET HKS BRASIL reserves the right to deny new registrations for USERS previously canceled, disabled, blocked, deleted, or suspended from the PLATFORM. The creation of new registrations by individuals whose original registrations were canceled, blocked, disabled, deleted, or suspended due to violations of AKQUINET HKS BRASIL’s policies or applicable law are expressly prohibited.
AKQUINET HKS BRASIL reserves the right to unilaterally, without prior notice, consent, or compensation, refuse any USER registration request on the PLATFORM, as well as cancel, disable, block, delete, or suspend the use of a previously accepted registration.
The PLATFORM offers the following services to USERS:
a. Workflow Management;
b. Management of Item, Business Partner, and Custom Domain master data;
c. Reports;
d. Portals;
e. APIs and webhooks;
f. General settings and adjustments.
The complete list of PLATFORM functionalities is described on the AKQUINET HKS BRASIL website.
Additional functionalities developed by AKQUINET HKS BRASIL and made available on the PLATFORM will also be subject to these T&S.
The USER expressly acknowledges that they do not hold any industrial and/or intellectual property rights over any component, creation, computer program, image, design, or any other data available on the PLATFORM.
AKQUINET HKS BRASIL reserves the right to modify the PLATFORM’s access conditions at any time and at its sole discretion, altering its design and/or presentation, adding or removing functionalities and/or information, or making any other changes, without granting the USER any right to claim damages for any reason.
Unauthorized use of the names and/or brands AKQUINET HKS BRASIL and MUB by the USER, including their legal representatives, agents, employees, or others, will result in the immediate termination of this contractual relationship, subjecting the offending party to applicable civil and criminal penalties.
AKQUINET HKS BRASIL will provide support to PLATFORM USERS every day during business hours (9:00 AM – 12:00 PM and 1:30 PM – 6:00 PM Brasília time) via email at [email protected], through the help desk, ticket submission, or remote assistance.
For support requests via email, AKQUINET HKS BRASIL will have up to 72 (seventy-two) business hours to respond.
Support will be provided at AKQUINET HKS BRASIL’s discretion based on its workload, and it cannot be penalized for instances where it is unable to assist the USER.
The USER understands that AKQUINET HKS BRASIL requires a minimum usage period on its PLATFORM. To cancel a monthly or annual subscription, the USER must notify AKQUINET HKS BRASIL with at least 90 calendar days’ notice, superseding any adjustments agreed upon in a separate contract between the USER and AKQUINET HKS BRASIL.
If cancellation is requested, the USER acknowledges that they will not be entitled to any refunds.
If AKQUINET HKS BRASIL identifies any remaining balance in favor of the USER, such balance shall be used to extend the Term until the balance is fully used in the PLATFORM. Under no circumstances will the remaining balances be returned to the USER in cash.
The USER understands that termination of their account on the PLATFORM will only be made by AKQUINET HKS BRASIL if the USER has no outstanding financial obligations.
AKQUINET HKS BRASIL reserves the right to suspend or terminate the provision of the PLATFORM at any time, at its discretion and without prior notice.
This T&S will remain in effect for the duration of the prepaid plan chosen by the USER or for as long as the free license granted is valid.
This T&S may be unilaterally terminated by AKQUINET HKS BRASIL in the event of non-compliance with any obligations assumed by the USER.
Upon termination of this T&S, the USER will no longer have access to the PLATFORM.
Payments will be made through the issuance of an invoice and subsequent bank deposit.
USERS accept and agree that the information registered on the PLATFORM may be published and/or provided as set forth in this T&S.
Data collected and processed by AKQUINET HKS BRASIL through the PLATFORM will be stored on servers subcontracted to Amazon AWS, a company headquartered outside Brazil, contactable via:

Data storage and PERSONAL DATA PROCESSING by AKQUINET HKS BRASIL will persist as long as the USER’s registration remains active on the PLATFORM.
Any information provided will be stored in a database controlled by AKQUINET HKS BRASIL. This database may be hosted on servers located outside the USER’s or AKQUINET HKS BRASIL’s country, owned by the subcontracted company mentioned herein, in compliance with the safeguards and protections required by Law No. 13.709/18 – LGPD (Brazilian General Data Protection Law).
The servers are owned and managed by service providers contracted by AKQUINET HKS BRASIL, such as AMAZON AWS.
Even when using computational infrastructure managed by third parties, AKQUINET HKS BRASIL does not authorize the use of USER information by the service provider in a manner inconsistent with the purposes outlined in this T&S.
AKQUINET HKS BRASIL selects world-leading data security service providers, and it disclaims liability for any potential hacker attacks or security technology failures that may expose this information, subject to its responsibility as provided under Brazilian Law No. 13.709/18 – LGPD.
AKQUINET HKS BRASIL protects all USER personal data using technically and economically reasonable standards of care, given the current state of internet technology.
The USER acknowledges that no complete security can be expected on the internet against website intrusions or other irregular acts.
AKQUINET HKS BRASIL reserves the right to provide USER data and information, as well as the entire system used in the PLATFORM, to its technical team, which may consist of AKQUINET HKS BRASIL employees and/or a subcontracted company.
All members of the technical team, whether employees or a subcontracted company, will sign a confidentiality agreement, committing to maintain strict confidentiality regarding all commercial, accounting, administrative, technological, infrastructural, technical, or any other data disclosed as a result of maintaining the PLATFORM’s operation and security. They will refrain from using such data for their own benefit or that of third parties and will ensure that their partners, employees, and trusted third parties, informed of this obligation, do the same.
AKQUINET HKS BRASIL is not authorized to provide personal data registered by the USER to third parties, except as provided in this T&S or in legally mandated cases. However, only information relating to an identified or identifiable natural person will be considered personal data.
Thus, market-related, operational, or other information not falling under the above definition will not be considered personal data.
It is the exclusive competence of Brazilian courts and legal authorities to request, with justification, that AKQUINET HKS BRASIL provide personal data of a USER who demonstrably violates the terms and conditions of this T&S or applicable legal provisions. AKQUINET HKS BRASIL reserves the right to provide such data to competent courts and legal authorities when duly requested.
The USER agrees to keep their registration data updated and to inform AKQUINET HKS BRASIL of any changes, particularly regarding payment details and their email address, which will serve as the primary communication channel between AKQUINET HKS BRASIL and USERS.
AKQUINET HKS BRASIL may amend this T&S at any time by publishing a revised version on AKQUINET HKS BRASIL’s website. For this reason, we strongly recommend periodically visiting this section of our site and reviewing it. However, to foster a good relationship, we will also send an email notifying you of these changes.
This T&S constitutes the full understanding between the USER and AKQUINET HKS BRASIL and is governed by Brazilian law. The jurisdiction of the city of Caxias do Sul – RS is hereby elected as the sole competent venue to resolve disputes arising from this T&S, with express waiver of any other jurisdiction, regardless of privilege.

No presente instrumento, entendemos as expressões abaixo de acordo com as seguintes definições:
AKQUINET HKS BRASIL: AKQUINET HKS SOLUCOES EM TECNOLOGIA DA INFORMACAO LTDA, sociedade empresária limitada, inscrita no CNPJ sob nº. 16.528.380/0001-71.
PLATAFORMA: sistema constituído por uma Plataforma Web disponível no link https://app.mub.one/ e seus subdomínios oferecida pela AKQUINET HKS BRASIL e de propriedade, operação e responsabilidade da AKQUINET HKS BRASIL, onde todos os USUÁRIOS podem visualizar e utilizar todas as funcionalidades disponibilizadas.
TRATAMENTO DE DADOS PESSOAIS: Toda operação realizada pela AKQUINET HKS BRASIL com dados pessoais dos USUÁRIOS, como as que se referem a coleta, produção, recepção, classificação, utilização, acesso, reprodução, transmissão, distribuição, processamento, arquivamento, armazenamento, eliminação, avaliação ou controle da informação, modificação, comunicação, transferência, difusão ou extração.
USUÁRIO(OS): Pessoa física ou jurídica cadastrada na PLATAFORMA, que acesse e/ou utilize os serviços ofertados por meio da PLATAFORMA.
Este instrumento regula as condições de uso dos serviços da PLATAFORMA, sendo um contrato entre os USUÁRIOS e a AKQUINET HKS BRASIL. A utilização de nossos serviços indica expressamente que você concorda com todos os termos e condições contidos neste instrumento e com as disposições legais aplicáveis à espécie.
O USUÁRIO entende que a contratação dos serviços ora ofertados se dará por meio de planos de assinatura grátis ou pré-pagos, mensais ou anuais, orçados e oferecidos pela AKQUINET HKS BRASIL.
Para utilização da PLATAFORMA o USUÁRIO compreende que precisará instalar todos os softwares necessários, bem como deter todos os equipamentos e licenças para o seu devido funcionamento.
O USUÁRIO se declara ciente de que os registros referentes à sua aceitação, juntamente da data e hora em que o aceite foi manifestado, bem como o registro de acesso e utilização da PLATAFORMA serão arquivados pela AKQUINET HKS BRASIL.
O USUÁRIO entende que o processo de implementação do software AKQUINET HKS BRASIL, após a contratação do serviço, terá um valor obrigatório de implementação orçado pela AKQUINET HKS BRASIL.
Se requisitado e de acordo com a disponibilidade da AKQUINET HKS BRASIL, o serviço de onboarding poderá ser ofertado ao USUÁRIO de forma remota por um dos Consultores da AKQUINET HKS BRASIL.
Caso você NÃO CONCORDE com os termos previstos neste T&S, NÃO CLIQUE EM “CADASTRE-SE” nem acesse, visualize, baixe ou utilize de qualquer forma nenhuma página, conteúdo, informação ou serviço da AKQUINET HKS BRASIL. A utilização de nossos serviços indica expressamente que você concorda com todos os termos e condições contidos neste T&S e com as disposições legais aplicáveis à espécie.
A AKQUINET HKS BRASIL é uma empresa privada, que oferece uma PLATAFORMA constituída por um software que busca otimizar e simplificar os processos de cadastro e de negócio, possibilitando que os USUÁRIOS tenham acesso a informações estruturadas em suas respectivas operações.
As responsabilidades da AKQUINET HKS BRASIL dizem respeito, única e exclusivamente, ao bom funcionamento da PLATAFORMA, e à garantia de acesso aos seus USUÁRIOS mediante pagamento prévio, através do portal https://app.mub.one/ e subdomínios.
A AKQUINET HKS BRASIL não detém nenhuma responsabilidade sobre:
(i) eventual descumprimento por um dos USUÁRIOS do que fora combinado no momento da negociação com os demais USUÁRIOS ou terceiros;
(ii) danos decorrentes da impossibilidade de uso da PLATAFORMA;
(iii) preenchimento incorreto dos dados pelo USUÁRIO na PLATAFORMA;
(iv) sobre os dados que são disponibilizados pelos USUÁRIOS através da PLATAFORMA;
(v) qualquer outro ato ou fato decorrente da conduta dos USUÁRIOS.
A AKQUINET HKS BRASIL outorga uma licença de uso temporária, não exclusiva, intransferível, e revogável a qualquer tempo, a seu critério, em favor dos USUÁRIOS, para acessar a PLATAFORMA, mediante as seguintes condições:
(i) Todos os serviços licenciados e utilizados, estão sujeitos às disposições deste T&S.
(ii) Os serviços licenciados deverão ser utilizados somente para as operações do USUÁRIO, não podendo cedê-los a terceiros.
(iii) Todas as licenças de uso comercializadas através do Portal são de caráter temporário, válidas pelo período pago pelo USUÁRIO, sendo que o não pagamento de qualquer novo período ensejará o cancelamento imediato do acesso ao serviço licenciado, que somente será reativado mediante a comprovação da quitação do débito.
(iv) Haverá a atualização constante de serviços licenciados através da PLATAFORMA, de forma automática sempre que houver lançamento de nova versão, podendo, assim, ocorrer, a qualquer tempo, mudanças nos serviços licenciados, em decorrência de atualizações de versão, com o que consente o USUÁRIO, ao contratar a licença de qualquer serviço.
(v) Os USUÁRIOS que aderirem ao plano de assinatura grátis da PLATAFORMA declaram estar cientes das limitações de uso pré-definidas pela AKQUINET HKS BRASIL, bem como que a AKQUINET HKS BRASIL poderá revogar a licença de acesso concedida a qualquer tempo e por quaisquer razões que ela entender cabíveis.
(vi) Os serviços disponíveis na PLATAFORMA são licenciados ao USUÁRIO, que deverá se assegurar de que o serviço, da forma como está disponível para licenciamento, atende às suas necessidades, não podendo imputar qualquer responsabilidade à AKQUINET HKS BRASIL, caso verifique, no futuro, que o serviço licenciado não atende suas necessidades.
(vii) Qualquer dano, a qualquer título, decorrente de mau uso, acidente, imperícia, imprudência ou negligência pelo USUÁRIO, no uso da PLATAFORMA, é de exclusiva responsabilidade do USUÁRIO, sem qualquer responsabilidade, solidária ou subsidiária, e a qualquer título, da AKQUINET HKS BRASIL.
(viii) A AKQUINET HKS BRASIL não assumirá qualquer responsabilidade por danos ao USUÁRIO, decorrentes de alterações não autorizadas na PLATAFORMA, invasões no sistema, vírus, e outros elementos nocivos.
(ix) A AKQUINET HKS BRASIL não assumirá qualquer responsabilidade pelas decisões do USUÁRIO, baseadas no uso das funcionalidades da PLATAFORMA.
O USUÁRIO compreende que para utilizar a PLATAFORMA deverá ter acesso a internet, do que a AKQUINET HKS BRASIL não detém responsabilidade.
A PLATAFORMA pode ser utilizada em dispositivos computacionais que contenham softwares para navegação na internet (navegadores) padrões de mercado, como por exemplo, versões recentes do Google Chrome e Firefox. Dispositivos móveis poderão acessá-lo através de seus navegadores, porém poderão sofrer restrições em algumas telas do sistema.
O USUÁRIO declara estar ciente que pequenos defeitos de programação, ou mesmo a indisponibilidade temporária da PLATAFORMA, são eventos comuns a todos os softwares, isentando, assim, a AKQUINET HKS BRASIL de qualquer responsabilidade por danos decorrentes de defeitos usuais e que fujam à normalidade da utilização da rede mundial de computadores, limitando a responsabilidade da AKQUINET HKS BRASIL à correção desses pequenos defeitos de programação.
Os serviços oferecidos pela AKQUINET HKS BRASIL estão disponíveis para pessoas físicas absolutamente capazes e pessoas jurídicas devidamente inscritas no CNPJ.
É necessário o preenchimento completo de todos os dados solicitados pela PLATAFORMA no momento do cadastro, para que os USUÁRIOS estejam habilitados a utilizar a PLATAFORMA.
O cadastro dos USUÁRIOS na PLATAFORMA será realizado através do fornecimento e tratamento dos seguintes dados para a AKQUINET HKS BRASIL: a) número do CNPJ do seu estabelecimento comercial ou seu CPF; b) nome completo ou razão social da empresa; c) nome do responsável administrador; d) endereço de e-mail; e) endereço completo; f) segmentos de atuação da empresa.
A coleta dos dados do USUÁRIO visa identificá-lo, bem como habilitá-lo ao uso dos serviços disponibilizados na PLATAFORMA, assegurando a qualidade dos serviços contratados.
O USUÁRIO reconhece que sem os dados acima referidos, a AKQUINET HKS BRASIL ficará impossibilitada de garantir o funcionamento da PLATAFORMA e, consequentemente, de prestar os serviços contratados.
É de exclusiva responsabilidade dos USUÁRIOS fornecer, atualizar e garantir a veracidade dos dados cadastrais, não recaindo à AKQUINET HKS BRASIL qualquer tipo de responsabilidade civil e criminal resultante de dados inverídicos, incorretos ou incompletos fornecidos pelos USUÁRIOS.
A AKQUINET HKS BRASIL se reserva o direito de utilizar todos os meios válidos e possíveis para identificar seus USUÁRIOS, bem como de solicitar dados adicionais e documentos que estime ser pertinentes para conferir os dados informados. Neste caso, o uso da PLATAFORMA pelo USUÁRIO fica condicionado ao envio dos documentos eventualmente solicitados.
O USUÁRIO acessará a sua conta na PLATAFORMA por meio de login e senha, comprometendo-se a não informar a terceiros estes dados, responsabilizando-se integralmente pelo uso que deles seja feito.
O USUÁRIO poderá utilizar a PLATAFORMA em quantos computadores quiser, respeitando o número de licenças contratadas.
O USUÁRIO poderá ter acesso às informações coletadas e tratadas pela AKQUINET HKS BRASIL, de forma gratuita, através do link https://app.mub.one/ e seus subdomínios, podendo solicitar a sua edição ou exclusão a qualquer tempo.
O USUÁRIO compromete-se a notificar imediatamente a AKQUINET HKS BRASIL, por meio do canal de ajuda mantido na PLATAFORMA, a respeito de qualquer uso não autorizado de sua conta.
O USUÁRIO será o único responsável pelas operações efetuadas em sua conta, uma vez que o acesso só será possível mediante a utilização de senha de seu exclusivo conhecimento.
O USUÁRIO compromete-se a notificar imediatamente a AKQUINET HKS BRASIL, por meio dos canais de contato mantidos pela AKQUINET HKS BRASIL na PLATAFORMA, a respeito de qualquer conhecimento de irregularidades de outros USUÁRIOS que possam ocasionar danos aos próprios USUÁRIOS da PLATAFORMA, a AKQUINET HKS BRASIL ou a terceiros.
Em nenhuma hipótese será permitida a cessão, a venda, o aluguel ou outra forma de transferência da conta do USUÁRIO.
Ao seu exclusivo critério a AKQUINET HKS BRASIL poderá excluir, inabilitar, suspender, bloquear, por tempo indeterminado, sem aviso prévio ou contrapartida indenizatória, cadastros de USUÁRIOS que infrinjam os termos deste T&S ou a legislação em vigor.
A AKQUINET HKS BRASIL se reserva ao direito de não permitir novo cadastro de USUÁRIOS que já tenham sido cancelados, inabilitados, bloqueados, excluídos ou suspensos da PLATAFORMA. É expressamente proibida a criação de novos cadastros por pessoas cujos cadastros originais tenham sido cancelados, bloqueados, inabilitados, excluídos ou suspensos por infrações às políticas da AKQUINET HKS BRASIL ou a legislação vigente.
A AKQUINET HKS BRASIL se reserva o direito de, unilateralmente, sem prévio aviso, anuência ou contrapartida indenizatória, recusar qualquer solicitação de cadastro de um USUÁRIO na PLATAFORMA, bem como cancelar, inabilitar, bloquear, excluir ou suspender o uso de um cadastro previamente aceito.
A PLATAFORMA oferece para os USUÁRIOS os seguintes serviços:
a. Gestão de Workflows;
b. Gestão de cadastros de Itens, Parceiros de Negócios e Domínios Customizados;
c. Relatórios;
d. Portais;
e. APIs e webhooks;
f. Ajustes e configurações gerais.
A lista completa de funcionalidades da PLATAFORMA está descrita no site do AKQUINET HKS BRASIL.
As funcionalidades adicionais desenvolvidas pela AKQUINET HKS BRASIL e disponibilizadas na PLATAFORMA também estarão submetidas a este T&S.
O USUÁRIO reconhece expressamente que não possui quaisquer direitos de propriedade industrial e/ou intelectual sobre qualquer componente, criação, programa de computador, imagem, desenho, ou qualquer outro dado disponível na PLATAFORMA.
A AKQUINET HKS BRASIL se reserva o direito de, a qualquer momento e a seu exclusivo critério, modificar as condições de acesso a PLATAFORMA, alterando seu design e/ou sua forma de apresentação, incluindo ou suprimindo funcionalidades e/ou informações, ou realizando qualquer outra alteração, de qualquer ordem, sem que tal fato resulte em qualquer direito de o USUÁRIO reclamar perdas e danos, a qualquer título.
A indevida utilização dos nomes e/ou marcas AKQUINET HKS BRASIL e, MUB, pelo USUÁRIO e inclusive pelos seus representantes legais, prepostos, colaboradores, dentre outros, ensejará na possibilidade da imediata rescisão da presente relação contratual, sujeitando a parte infratora às sanções cíveis e penais aplicáveis ao caso.
A AKQUINET HKS BRASIL prestará suporte aos USUÁRIOS da PLATAFORMA todos os dias em horário comercial (09h00 – 12h00 e 13h30 – 18h00 horário de Brasília) através do e-mail [email protected] por meio da central de ajuda, abertura de chamado ou assistência remota.
Nas solicitações de suporte via e-mail, a AKQUINET HKS BRASIL terá até 72 (setenta e duas) horas úteis para proceder à resposta.
O atendimento será feito a critério da AKQUINET HKS BRASIL de acordo com a sua demanda de trabalho, não podendo ela ser penalizada nos casos de impossibilidade de atendimento do USUÁRIO.
O USUÁRIO compreende que a AKQUINET HKS BRASIL exige tempo mínimo de uso na sua PLATAFORMA, bastando o USUÁRIO solicitar o cancelamento de sua assinatura mensal ou anual à AKQUINET HKS BRASIL com o tempo de antecedência de 90 dias de calendário, se sobrepondo qualquer ajuste firmado em contrato particular entre o USUÁRIO e AKQUINET HKS BRASIL.
Caso seja solicitado o cancelamento, o USUÁRIO fica desde já ciente de que não fará jus a qualquer reembolso.
Se a AKQUINET HKS BRASIL identificar qualquer saldo remanescente em favor do usuário, referido saldo será utilizado para extensão do prazo de vigência até que o saldo seja integralmente utilizado na PLATAFORMA. Em nenhuma hipótese saldos remanescentes serão devolvidos ao USUÁRIO em espécie.
O USUÁRIO compreende que o encerramento de sua conta na PLATAFORMA só será efetuado pela AKQUINET HKS BRASIL caso o USUÁRIO não possua pendências financeiras.
A AKQUINET HKS BRASIL se reserva ao direito de suspender ou encerrar o oferecimento da PLATAFORMA a qualquer tempo, a seu critério e sem aviso prévio.
O presente T&S vigorará pelo tempo de contratação do plano pré-pago escolhido pelo USUÁRIO, ou ainda enquanto for válida a licença gratuita.
Este T&S poderá ser rescindido unilateralmente, pela AKQUINET HKS BRASIL, na hipótese de inadimplemento de alguma das obrigações assumidas pelo USUÁRIO.
Em caso de término deste T&S, o USUÁRIO não poderá mais acessar a PLATAFORMA.
Os pagamentos serão realizados através da Emissão de Nota Fiscal e posterior depósito bancário, ou PIX, mediante a Chave CNPJ: 16.528.380/0001-71.
Os USUÁRIOS aceitam e concordam que as informações cadastradas na PLATAFORMA sejam publicadas e/ou fornecidas de acordo com o previsto neste T&S.
Os dados coletados e tratados pela AKQUINET HKS BRASIL através da PLATAFORMA serão armazenados nos servidores de empresa subcontratada Amazon AWS, cuja sede fica fora do país e que pode ser contatada através do link:

Ainda, o armazenamento e TRATAMENTO DE DADOS PESSOAIS pela AKQUINET HKS BRASIL perdurará pelo tempo que o cadastro do USUÁRIO se mantiver ativo na PLATAFORMA.
Qualquer informação fornecida será guardada numa base de dados controlada pela AKQUINET HKS BRASIL. Essa base de dados poderá ser armazenada em servidores não localizados no país onde o USUÁRIO se encontra nem onde a AKQUINET HKS BRASIL se encontra, de titularidade da empresa subcontratada aqui referida, o que observará os devidos cuidados e proteções determinadas pela Lei 13.709/18 – LGPD.
Os servidores são de propriedade e administrados por prestadoras de serviço contratados pela AKQUINET HKS BRASIL, como a AMAZON AWS.
Mesmo utilizando infraestrutura computacional administrada por terceiros, a AKQUINET HKS BRASIL não autoriza o uso das informações do USUÁRIO pela prestadora de serviço em desconformidade com as finalidades previstas neste T&S.
A AKQUINET HKS BRASIL utiliza prestadoras de serviço líderes mundiais em segurança de dados, e se exime de responsabilidade por qualquer possível atentado hacker ou falha das tecnologias de segurança que possam levar essa informação a ser exposta, observado a sua responsabilidade, conforme disposição da Lei 13.709/18 – LGPD.
A AKQUINET HKS BRASIL protege todos os dados pessoais do USUÁRIO utilizando padrões de cuidado técnica e economicamente razoáveis considerando-se a tecnologia atual da Internet.
O USUÁRIO reconhece que não pode haver expectativa quanto a segurança total na Internet contra invasão de websites ou outros atos irregulares.
É reservado o direito da AKQUINET HKS BRASIL em fornecer os dados e informações do USUÁRIO, bem como de todo o sistema utilizado na PLATAFORMA, para sua equipe técnica, podendo ser formada por funcionários da AKQUINET HKS BRASIL e/ou por empresa terceirizada.
Todos os integrantes da equipe técnica, sejam funcionários ou empresa terceirizada, firmarão termo de confidencialidade, declarando que se obrigam a manter sob absoluto sigilo todas as informações comerciais, contábeis, administrativas, tecnológicas, infraestruturais, técnicas, ou seja, quaisquer dados revelados mutuamente em decorrência da manutenção do funcionamento e segurança da PLATAFORMA, abstendo-se de utilizá-las em proveito próprio ou de terceiros, comprometendo-se a zelar para que seus sócios, funcionários com vínculo empregatício e terceiros de sua confiança, informados dessa obrigação, também o façam.
A AKQUINET HKS BRASIL não está autorizada a fornecer dados pessoais eventualmente cadastrados pelo USUÁRIO a terceiros, a não ser nas formas previstas neste T&S ou em casos legalmente previstos. Entretanto, serão considerados dados pessoais apenas aquelas informações relativas a uma pessoa natural identificada ou identificável.
Sendo assim, informações mercadológicas, operacionais ou que não se enquadrem na definição referida acima não serão consideradas dados pessoais.
É de competência exclusiva da Justiça e órgãos legais do território brasileiro requerer fundamentadamente à AKQUINET HKS BRASIL o fornecimento de dados pessoais do USUÁRIO que comprovadamente desrespeitar os termos e condições presentes neste T&S e as disposições legais aplicáveis à espécie, reservando-se à AKQUINET HKS BRASIL no direito de fornecer à Justiça e órgãos legais competentes os dados pessoais do USUÁRIO, quando fundamentadamente requeridos.
O USUÁRIO se obriga a manter atualizados seus dados cadastrais, bem como informar qualquer modificação, especialmente seus dados de pagamento, bem como seu endereço de e-mail o qual será o principal canal de comunicação entre a AKQUINET HKS BRASIL e os USUÁRIOS.
A AKQUINET HKS BRASIL poderá alterar este T&S a qualquer momento, bastando, para tanto, a publicação de uma versão revisada no website da AKQUINET HKS BRASIL. Por este motivo, recomendamos veementemente que sempre visite esta seção de nosso site, lendo, periodicamente. Entretanto, para contribuir com o bom relacionamento, também enviaremos um e-mail informando acerca dessas mudanças.
O presente T&S constitui o entendimento integral entre o USUÁRIO e a AKQUINET HKS BRASIL e é regido pelas Leis Brasileiras, ficando eleito o foro da cidade de Caxias do Sul – RS, como único competente para dirimir questões decorrentes do presente T&S, com renúncia expressa a qualquer outro foro, por mais privilegiado que seja.
